These Terms apply when a business owner, team member or other authorised user creates an account, manages a business workspace, publishes customer pages, accepts bookings or orders, enables add-ons, connects payment services, uploads content, or otherwise uses Served HQ.
1. Parties and platform role
Served HQ is a software platform for businesses to create customer-facing pages, manage services, bookings, orders, loyalty, QR codes, add-ons and related operational tools.
Unless expressly stated otherwise, the business using Served HQ is the seller, service provider, merchant of record or responsible operator for its own goods, services, prices, fulfilment, customer promises, refunds, cancellations, taxes, legal disclosures and customer support.
2. Business accounts and authority
- You must provide accurate account, business, billing and contact information.
- You confirm that you have authority to bind the business you create or manage on Served HQ.
- You are responsible for all staff, invited users, passwords, permissions, API usage and activity in your workspace.
- You must tell us promptly if account access, payment settings or business ownership changes.
3. Customer relationships and business responsibility
Customers who place orders, make reservations, join loyalty programmes, submit forms, scan QR codes or otherwise interact with a business page are customers of that business. The business is responsible for handling those customer relationships lawfully and fairly.
- Businesses must honour accurate published prices, availability, cancellation terms and service descriptions.
- Businesses must handle customer enquiries, complaints, food or product issues, no-shows, cancellations and fulfilment disputes.
- Businesses must comply with consumer protection, advertising, privacy, food, health, licensing, tax, accessibility and sector-specific rules that apply to their operations.
4. Payments, platform fees and third-party providers
Some Served HQ features use third-party payment infrastructure. Businesses may need to connect their own payment account before accepting online payments. Payment providers may impose their own terms, checks, reserves, verification requirements, payout schedules, fees and restrictions.
- Served HQ may charge subscription, add-on, platform, service or transaction-related fees as shown in the product, checkout or billing area.
- Fees may be changed prospectively with reasonable notice unless a separate written agreement says otherwise.
- Businesses remain responsible for payment provider fees, refunds, chargebacks, reversals, disputes, failed payments, taxes and negative balances connected to their sales.
5. Add-ons, subscriptions and billing
Add-ons are optional modules that may be billed monthly, annually, per use, by transaction, or on another stated basis. A business may lose access to paid add-ons if billing fails, the add-on is cancelled, or the account is suspended.
Unless stated otherwise, cancelling an add-on stops future renewal but does not automatically refund past periods, setup work, consumed usage, payment provider fees or completed services.
6. Content, intellectual property and uploads
Businesses keep ownership of their menus, service descriptions, prices, logos, images, brand assets, copy and other uploaded content, but grant Served HQ the rights needed to host, process, display, resize, cache, transmit, back up and operate that content as part of the platform.
- You must only upload or publish content you own, are authorised to use, or can lawfully license.
- You must not copy third-party menus, images, trademarks, designs, reviews, customer lists or copyrighted material without permission.
- We may remove, restrict, disable or refuse content that appears unlawful, infringing, misleading, harmful, high-risk or incompatible with the platform.
7. Customer data visible to businesses
Served HQ may show businesses customer details submitted through their own pages, such as names, email addresses, phone numbers, order details, reservation details, loyalty identifiers, notes, addresses where enabled, payment status and related operational history.
Businesses must only use customer data for legitimate business purposes connected to the relevant order, booking, loyalty account, service, support request, lawful marketing consent or legal obligation. Businesses must not sell, misuse, scrape, expose or unlawfully share customer data obtained through Served HQ.
8. Availability and changes
We aim to keep Served HQ available and useful, but the platform may be interrupted for maintenance, upgrades, security work, third-party provider issues, network failures or events outside our control. We may change, improve, suspend, withdraw or replace features where needed.
9. Suspension, deactivation and enforcement
We may suspend, restrict, deactivate, remove content, disable payments, block users, refuse service or terminate access with or without notice depending on the circumstances. This may happen where we believe there is fraud, abuse, unlawful activity, payment risk, chargeback risk, intellectual property infringement, security risk, misleading content, policy breach, sanctions risk, non-payment, harm to customers, or risk to Served HQ, other businesses or third-party providers.
10. Liability limits
Served HQ provides software tools. Businesses are responsible for their own operations, customer promises, goods, services, regulatory compliance and payment outcomes. To the maximum extent permitted by law, we are not liable for lost profits, lost revenue, lost data, reputational harm, indirect losses, customer disputes, business interruption or issues caused by a business, customer, payment provider, hosting provider or other third party.
11. Updates to these terms
We may update these Terms as the product, legal requirements or risk environment changes. Continued use of Served HQ after an update means you accept the updated terms.
